1. For estate planning, I assist my clients prepare their Wills in accordance to how they want their estate to be distributed upon their death. I also urge clients to prepare a Lasting Power of Attorney (LPA), while they still have their mental capacity, to decide who will make decisions for them if they lose their mental capacity.
2. I also assist my clients with applications for a Grant of Probate / Letters of Administration to administer and distribute the estate of a deceased. Legal fees may vary depending on the amount of due diligence required (e.g. writing to banks for information if you do not know the deceased’s assets), and/or whether there are special issues that need to be dealt with (e.g. the presence of overseas properties, hostile parties, etc.). I also advice on / assist with applications under the Mental Capacity Act, where a person has lost his/her mental capacity.
3. Either way, I always start with a consultation. No matter how “simple” or “straightforward” a matter, it is important for clients to appreciate all relevant considerations (legal / practical) before proceeding with any action.
